Help me get my ducks into a row - excessive vibration 24 hrs

I just moved into a new apartment. During my first night here I noticed an annoying vibrating noise that the landlord says can not be fixed. It sounds like I am living inside of a washing machine or a vacuum cleaner. It goes on 24 hours a day but is louder at certain times of the day, say 5:30 than at other times of the day. It can be heard all throughout the apartment but mostly the bathroom and bedroom area. The landlord has agreed to let me out of the lease if he can find another renter. Given the large number of apartments that are free right now, I don't believe that he's going to be able to find one.

I have videotapes and am waiting for the DEP to respond to my complaint (I was told that it would take 5 days). What else can I do to document my case?
