LL right to inspection of apartment?

Our landlord has requested, in writing, a formal inspection of our non-regulated Brooklyn apartment to "assess safety or repair issues". Our lease expired a year ago, and we have been on a month-to-month basis ever since. I suspect she wants to see if we have done damage to her apartment - the apartment is in good shape, other than minor wear-and-tear, and shelving that we have hung in the kitchen, bathroom, and bedroom. We plan to continue our residency for awhile.

Two questions:

- Does she have a legal right to an inspection, and can she set the date of the inspection?

- Were we legally allowed to hang shelves, or should we try to take them down and Spackle the holes before the inspection?

Yes.
The LL has the right to inspect the apartment as long as you get reasonable advanced notice. In fact, more than once a year if they choose to.
Why would you not want him to? It's to your benefit also.

I would talk to the LL about the shelves. This isn't the reason for the inspection. If the LL has an issue with them then you don't have to do anything about it until you leave, giving the apartment back in the same condition as when you rented it.

It's not that simple as just providing advance notice. There are specific rules covering access. See the LL access thread in the Reference Section (link above).

You can choose to stick by the letter of those rules, but keep in mind your status as month-to-month tenant. Generally access date/time can be negotiated.

No need to take down the shelves now.
