I moved here from Toronto. There, renters are legally allowed to elect to go to a month-to-month lease after fulfilling a year-long lease. Does anyone know if the same rules apply in Brooklyn? Or is going to month-to-month solely at the discretion of the landlord? I'd really appreciate any help anyone can give me! Thanks!

I believe that if it is a non-regulated apartment it's up to the landlord if he chooses to make you sign a lease or have you as a month-to-month tenant.

In New York City (which includes the borough of Brooklyn), the agency that has oversight of such matters is the Division of Housing and Community Renewal. Their number is (718) 739-6400.

Concord, you are incorrect. This is posted in the non-rent regulated forum. DHCR has no jurisdiction if the unit is legitimately unregulated.

Thanks for the correction Tenantnet.

My intent was really to steer him toward DHCR for general questions related to housing matters. DHCR was a general starting point for me and I figure they could give him some guidance and insight.

On that note, who does make the rules for unregulated apartments? What’s a Torontonian to do, hey?

Unregulated tenants are covered by the lease, contract law and the Real Property Law.

All tenants are covered by HPD, HMC, MDL, DOB and others
