Eviction case after request to break lease ignored

Postby sprine » Fri Mar 13, 2009 3:08 pm

Hi there,

I'm dealing with a crazy landlord. A month ago I sent a letter stating that I wanted to break my lease. I never received a response so I assumed that my request wasn't granted but then a month later I found out that my landlord was beginning a case to evict me. Has anyone ever heard of anything so crazy like this? Does any one have any advice.

When you say the LL is starting a case, what has happened specifically? In unregulated units, most often eviction proceedings are based on either non-payment or some behavior that can be deemed to have violated the lease.

You can, of course, move out whenever you wish. The question is if you would be liable for the rent for the remainder of the lease term. If the LL re-rents the place, that obligation would go away. And the LL can agree (in writing) to terminate the lease without further obligation.
