Signing lease, apt under renovation

The broker called me to come in to sign the lease. Saw the place but the kitchen and bathroom were gutted and in the process of being renovated...broker showed me a picture of the new bathroom and the super showed me a kitchen from a different unit. So what terms should the prop. manager have on the lease in this case? If the lease starts on Sept 1st and the job isn't done...should I add some terms to the lease? Thanks

Add this:


This lease shall go into affect on the first day of the month following such time when the apartment is fully functional with all facilities including bathroom (sink and bathtub with shower) and kitchen (sink and oven/stove and cupboards), and, when both parties [tenant and the broker/landlord] sign this sheet agreeing upon the actual move-in date.

If the apartment is not fully functional by October 1, 2009 the tenant shall be relieved of any obligation under this lease.

(This should be typed on the broker’s letterhead.)
