A mom with a 3 year old son with autism is being threatened with an eviction, because the LL says he makes too much noise. One day he dropped a spoon on the floor, and they were knocking on her door complaining. She is not in a rent stabilized apartment. What reason would he use to file for an eviction? He said he wants her out by August 31st, but that will be almost impossible.

I'm waiting to hear back from the mom, but what would be the scenario if there was a lease and if there wasn't a lease? Thanks.

I guess what I was hoping was that there might be some kind of glitch with the eviction because the child is disabled. But that was only wishful thinking. It's a cruel world, especially when kids are going to be kicked to the curb, so to speak, through no fault of their own, by an uncaring LL, who agreed to rent to the family, knowing that their little boy had autism. Disgraceful.

Hi All
I'm slightly off topic so please bear with me a moment. Queensborough, since the child is autistic, speak to the parent to see if they have what is known as a case manager. CM's are support services for persons with disabilities. It is the job of a CM to assist with such a situation & they have access to a number of services as well as emergency housing generally through Child Protective Services.
