Lease Renewal Question.

I think my landlord is trying to pull a fast one on my roommates and I.

There are 3 of us in the apartment and all 3 of us are signed to the lease.

The lease is up Oct 1st and the landlord is asking us to resign it.

One of our roommates has decided to move - the rest of us are staying.

But after finding out that one of our roommates is going to move out, the landlord wants to rewrite the entire lease and have us go through complete credit checks, even though we have signed the lease previously without any background check.

The landlord only made us aware of this change on September 4th - Less than 30 days before the renewal is due.

The landlord also did not send us a lease renewal 90 days before the lease was to expire even though we have asked for it repeatedly. She has only called us with verbal reminders to sign it but had failed to give it to us until September 4th.

Now she is claiming that this is a brand new lease and not a renewal at all.

What can be done here? Has she broken any renter's laws?

All we want to do is resign the lease and move on with our lives.

BTW - We have been living at the apt for the past 3 years. We have renewed our lease twice before without any problems.

Hi All
To the best of my knowledge since you are not regulated the LL can pretty much decide how they want to extend a lease and at what increase in rent. It appears that since there is a change of income from 3 tenants to 2, the LL is going to determine if the two of you can cover the rent.
