NYC- ONLY court order can evict me? (no lease)

Postby psert » Sun Sep 20, 2009 7:56 pm

I am living in a guest house, month to month, no lease. I am a few days behind on my rent. I have had financial difficulties the last 6 months, so I have been 7 days to as much as 20 days late, each of these 6 months.

I have lived here total for 2 years. For what it's worth, the first 18 months was on time.
Now, landlord has said, "You can't pay. You get out."
I will have the full rent again, but it will be 7 days late by the time I get it to the landlord.
I understand in NYC I can't be forcibly evicted, unless by a court order, and subsequently by a city marshall or sheriff.

Is this correct?

Thanks much,
Peter s.

Yes, that's correct. And if that's your real name, take it off the post and change your user name. You think your LL can see it?
