And possession can be transferred prior to the lease ending by agreement between the parties ... and by handing over the keys, removing tenant's possessions, etc. Sure, it's better if the agreement is on paper, but doesn't have to be.

Free Month Part of New Lease

LLB,

My lawyer says that because the "free" month is in a clause of the new lease, it part of the new tenants responsibility, and not mine.

I agree with you, by the time the new tenant signed the lease for that appartment, its effective, and your lease was terminated, LL cannot double dip, this is what I've read from de castro rentlaw website and in their show someone asked this question too.

And your lucky because they re rented it, because if not, they can file for a claim for the rest of the lease. So for the month of October, you should pay it, you said you leave 9/30 handed over the keys, but by that time you violated the lease, so you need to pay for October when the appartment was vacant.
