Illegal Attic Apartment

I recently went onto the DOB website and found out that a complaint was made about my apartment. It said that it is an illegal dwelling without a permit.
I then tried to figure out for myself if it illegal or not. I phone DOB and found out that the certificate of occupancy does not match the setup of the building. I tried to schedule an inspection but they will not set a date/time.
I have had numerous problems with this apartment(major one being I am asthmatic and the building is full of smokers) and would like to vacate. I signed a lease that was dated the wrong year, and they said they would rewrite it, but never did. And the landlord is very uncooperative, so i am hesitant to approach him.
If anyone has any ideas of where to go from here, I would very much appreciate it.
