My subtenant has not moved out!

Postby inbk » Tue Aug 31, 2010 3:12 pm

Hi everyone.

So I'm a little panicky because my lease has expired and my subtenant has not moved out. As a result, my landlord is threatening to serve me with papers.

As for the subtenant, I received verbal permission to sublet the apartment. I had the subtenant sign an agreement with me that indicated the move out date. Two days ago, she notified me that she had not found a new place yet.

I do not live in the apartment.

So I want to know what my course of action should be.
-What are my rights vis-a-vis the landlord and vis-a-vis the subtenant?
-Am I totally responsible to evict the subtenant if they don't move?
-What are my responsibilities to landlord? Can they sue me?

It has been a frustrating subleasing experience to say the least.

Thanks in advance.
