rent payments and fees

Postby bozmanbeyond » Thu Sep 16, 2010 7:43 am

Some were down the line I had forgotten to pay the late fee on my rent so what they have been doing is is taking part of my rent for the past few months now and applying it to my past due. Now I got this letter saying I owe 225 + 150 late fee for the month of August. Now they are trying to make it look like I only paid part of last months rents and applying late fees on top on another late fee. Is this legit to do?

Look at the fine print on your lease. Chances are they are applying any recent payment to any outstanding amounts from prior months. While you may be thinking you're paying the current month's rent, the LL is using it to pay off additional fees applied from previous months.

The question in my mind is whether the late fees (from any month) were appropriate or legal. See the section on late fees in the Forum's Reference section.
