no court notice received -- time frame ?

HI,

I see on ecourt my LL's have filed a holdover proceeding on me (afraid to post details , they may be lurking ) for non occupancy. THe date is a little over a week from now. I have received no notices to appear in court. Is that court date just for them ? I am scheduled to be away on business on that date. is there a time frame that they have to notify you in ? Or can I expect a last minute you need to be in court letter ?

the minimum time for service in a holdover is 5 days before the court date. so expect to get served very soon.

Is that court date just for them ?


there is no such thing. you both have to appear in court.

When you say non-occupancy, do you mean they are claiming the unit is not your primary residency? If so, these can get complicated and we recommend you consult with a tenant attorney ... even if it's bogus.

On the first day it's likely to be adjourned. If you're in the process of getting legal assistance, tell the court that.
