Do you pro-rate rent based on a 30- or 31-day month?

Is there a standard way of pro-rating rent (when the landlord is okay with pro-rating)?

Would you suggest I divide my rent by 30 or 31 to determine the daily rate?

I realize this is likely not an issue of law and if we both agree, it's no big whoop; I'm just wondering if there's a standard way people normally go about it.

Why are you pro rating?

Generally you would go with 30... But for what reason?

I'm prorating because I am likely moving out before the end of the month, and do not wish to pay for the portion of the month I do not live in the apartment.

Generally you can't prorate for that reason unless the LL really agrees. You paid for the month, you got the whole month buddy! That's why the leases all set the unit of time rented in monthly increments.

It's not like he can have someone come right in an hour after you move.

But if he agrees to it, then you are in good shape.

I understand that. This is a roommate, and I have every expectation that she'll agree to this. (For all I know, it may even be provided for in our written agreement; I've asked her for a copy, because I can't find mine.)

Unless she's loaded with cash it is particularly unfair in a roommate situation. Think about it. Rent has already been paid for the month.

But if she agrees then more power to you.

Somewhere on this forum among the 40,000+ posts is a discussion on the legal basis of this topic. I couldn't find it, but I remember it. In most situations, unless the lease specifies differently, one pays by the month (some SROs and boarding houses might be different).

If the LL agrees to let you off early, get it in writing.

Next time keep your agreement somewhere off-premises. She might have swiped it from your room!
