problems with neighbors grilling

Hi board,
I have an issue with a super, his grill is underneath my windows in the buildings backyard and he barbecues 3-4 times a week. I can't open my windows when he barbecues, and I need to tape up my air conditioner otherwise my entire apartment gets filled with the smoke. It is a building with many apartments in Queens.

The building owner does not care. Is this legal?

Well, if it's in the backyard, then I don't think it's illegal. If it were on the balcony or fire escape, that might be different. Here's some info on barbequeing: https://www1.nyc.gov/site/buildings/hom ... ecues.page

How close is it to the building. Have you asked him if he could move it further away from the building? That's might not be perfect, but would be less an imposition.

For smoke and fumes, I'd contact the NYC Dept. of Environmental Protection. They might have jurisdiction over fumes and smoke.
