Penalty for transferring succesion rights twice?

Hi,

I read somewhere that if someone in a mitchell lama apartment claims succession rights, there is no fee for doing so the first time. But then if succession right is claimed again for the same apartment (after it was already done once before), there is a fee or penalty.

Is that true? What is the penalty or fee (how much)? Is there a specific link to that?

I don't know if the same is true for Mitchell Lama but, with standard Rent Stabilized apartments, there is no increase with the first sucession, but there is the normal vacancy increase with subsequent succesions.

What would that mean? Does that mean an increase in rent, or a one time fee? Is there a way to calculate that?

Under Rent Stbilization, it's a rent increase - not a penalty or one time fee.

However, I don't believe all Mitchell Lama apartments are subject to the same guidelines. Some, if not all, have specific guidelines for income and family composition.

You probably should call DHCR for a definitive answer.

I'll do what you said, and call dhcr.

But in the mean time, any idea how they calculate the rent increase?

Does the rent go up to say market value or something?
