RENT INCREASE?!!

I LIVE IN A 1BR APT IN BKLYN. SOME PEOPLE WHO LIVE IN THE BUILDING OWN THEIR APTS SOME DONT. WE ARE PAYING RENT TO A MGMT CO. THEY OFFERED A NEW LEASE FOR $1450 A MONTH, PREVIOUSLY THE RENT WAS $950 A MONTH, THEY SAID IT WAS A FAIR INCREASE BECAUSE WE HAVE A 2 BD RM APT!! THEY ARE CALLING OUR DINING RM WHICH IS ATTACHED TO THE KITCHEN A SECOND BED RM!! CONFUSED PLS HELP!!

Does your Dnrm have a window, dor it have a closet. Certain distinctions make a room a bdrm and one of them is a window.

To be listed as a bedroom, it has to have a door, a window and a closet. Not to mention four walls. At best, a LR/DR combo can be referred to as a Jr. 4.

Are you rent-regulated? Is this a completely new lease, with new terms and conditions, or a renewal with added terms and conditions, like a sudden $500 rent increase?

We really need to know these details before we can ascertain what your rights are.

You say that some tenants own their apartments. Did you or your family live in this apartment when the building was turned into a co-op or condo? If not, you are probably not covered by rent regulations and in that case the LL may refuse to renew your lease at all or may demand a higher rent for a renewal lease.

WE DID NOT LIVE HERE B4 IT TURNED TO A COOP...THERE IS A WINDOW BUT, NO CLOSET AND ONLY 3 WALLS BUT,WHERE THE FOURTH "WALL" WOULD BE IS THE KITCHEN THERE IS A DOORWAY INTO THE LIVRM. THE REP CAME HERE AND SAID "OH! IN SOME APARTMENTS THIS WALL IS BLOCKED OFF AND A DOOR IS ADDED THAT'S WHY IT'S A RM! BUT OURS DOESNT HAVE THOSE ADJUSTMENTS. HE ALSO TOLD ME IT WOULD BE CHEAPER JUST TO BUY IT(WITH MAINTENANCE
AND PAYMENTS IT MIGHT COME TO AROUND $1250).

THE SENT US A "RIDER" SAYING THEY WOULD INCREASE THE RENT FOR THE RENEWAL AND THEY ALSO ASKED FOR MORE MONEY TO ADD ON TO OUR SECURITY DEPOSIT.

It's irrelevant if the room is a dinning room or bedroom. If this is a non-regulated unit they're allowed to raise the rent to any amount they choose.
