HDFC - Can "tenant/owner" transfer shares to famil

Postby rdturner » Wed May 20, 2009 2:27 pm

Facts: Grandma served with Notice to Cure Lease violation ("primary residence" clause - she's in the hospital and has been for a while). Has been tenant for 30 years or more, was there when building went TIL, then HDFC. Looks like she may not be able to return to apartment due to health condition (she's 96 y.o.).

Question: Generally, can a tenant/owner simply transfer shares to family member?

This appears to be a coop, which means this really isn't a tenant issue. But in this HDFC, is there any mention of residents having to follow RS rules? If so, they can't extinguish one's RS tenancy rights for being in the hospital or a nursing home. Moreover, succession rules might apply.

But that depends on to what extent RS rules might apply.

You might want to check out http://forums.prospero.com/HDFCCentral
although I don't know if the site is any longer being maintained.
