landlord charging communal damage fees

My sister received a letter from her landlord saying they are charging all building residents a fee because of damages that had to be repaired and things that needed to be cleaned. They are apparently charging everyone because they can't pin it on any individual. Is this legal?

Secondly, they are charging my sister for a broken window that was a result of a burglary. She said the landlords knew the place was broken into, but she never reported it to the police (doesn't have a report). Is this her responsibility to pay for? Can she sue the landlords for lack of security?

Sounds pretty illegal to me, especially if you have a lease. Even if you don't, I don't think it's enforceable. It's called maintenance ... and that's covered by rent.
