changing coop laws to outlaw pets

Postby WMNF48 » Fri Apr 26, 2002 7:04 am

The Board in our building, a coop, distributed an amendment to our by-laws related to limiting the number of pets residents have to 2, not to be replaced if they die. Several of us have 3 pets. Can they be "grandfathered" to remain residents here? Is there a lawyer I can retain to review the legal agreement I must sign?

To answer the poster, a number of good tenant attorneys advertise on TenantNet. Please support our advertisers and shop around. But I'm not sure if you "must" sign something. And chances are you would be grandfathered. But that's just a guess. That's a position you could take, and that's why God made courts.

I believe a by-law change has to be approved by a majority of the shareholders, if not some supermajority. Read your by-laws/offering plan. This is a opposed to a house rule change that can simply be imposed by the board.

If they do need to put it to a vote by the shareholders, start lobbying to defeat the proposal. Also, you might want to try to get yourself on the board. You're better off being on the inside of these things, than on the outside.

absolutelyyou are grandfathered. your animal has been there over 30 days. they mess with you , you tell them 1) there have been no cpomplaints about yyour well behaved animals, 2) you will take it to court and it will cosg the coop lots of legal fees and then you circulate this to all the other residents so they know it will cost them. dont budge and inch on it. coop boards are a notorious pain - DO NOT SIGN ANY LEGAL AGREEMENT - YOU ONLY HAVE TO ABIDE BY THE LEASE YOU GOT EHEN YOU MOVED IN.
