Hello,

I am looking into moving into a loft space in a building that has IMD status. However, the space is being offered with a commercial lease and I would be living there without explicitly announcing my intention to do so. I know that other people are living in the building and have been there for many years (and i suspect are the reason for the IMD status in the first place).

i am wondering what legal issues might arise from living in this space. Can I be evicted for living there? With IMD, is the building legal to live in? or must I have been living there since the 80's?

Any advice is greatly appreciated.

Learn about IMDs: lmlt.org

Talk to existing tenants.

Research your bldg and LL: nyc.gov/acris

You probably shouldn't be signing a comm lease: consult a tenant atty with Loft exp.

You can go to the NYC Dept. of Buildings (DOB) website and do a "Building Information Search" (BIS) for your building.

Look for the Certificate of Occupancy for your building and you might be able to determine whether your unit is commercial or residential.

Loft Law is very specific and you should find out all you can before you sign the lease.

A consult with a good tenant lawyer with expertise in Loft Law would be a very smart move.
