2nd egress from apartment bedroom is to a pit

My mother just rented an efficiency apartment here in Colorado. The building is very old, but newly remodeled/converted into apartments. The front room has the kitchen, a window to the outside, and the main exit to indoor stairwell. The bedroom has one window...which opens onto a coffin-sized open-air space, 10 feet deep. There is no ladder in the space.

I was very disturbed to see it, as no one could possibly escape from that in the case of a fire.

Can that be legal?

You need to check with the local municipality building's department and/or fire department.
