Grace Period for payment of rent?

Postby robrenahan » Thu Oct 01, 2009 2:42 pm

Hi,

Is there a grace period by law of when tenant can pay rent? For example, rent payment is due 1st of month.....how many days after such due date by law does the tenant have before the landlord can charge a late fee on late rent?

Thanks,

Rob

Thanks for fast reply. So does that mean that the landlord can give late fees even if the payment is one day late?

It is a month to month.

If it's a month-to-month, are you saying there is no lease (or was no initial lease) that spelled out late fees? If so, then they can't create late fees on a whim.

The grace period must be written in the lease. If no grace period is written rent is legally due on the 1st of the month. If late fee are written in your lease, you will be charged a late fee for not paying the rent on time. Usually $50 or 5% of the rent.
