How long does eviction take from Mitchell Lama

I have been subletting in this apartment for 3 years, giving cash to the super only to find out recently this whole building should be Mitchell Lama and the woman whose name is on the lease is probably deceased. I recently received a "Preliminary Notice of Grounds for Eviction" siting "28 RCNY 3-02 (n)(4)". About half the tenants are in the same situation.

It says I have to leave by June 16 or they will apply to HPD for a "Certificate of Eviction" at which point I could ask for a court date. How long will all that take? Realistically how long do I have if I follow through with the hearing?

And do I have any rights to a settlement since I have been here for 3 years and have been paying about 3 times what the actual rent is all that time?!

Without getting into all the details of Mitchell-Lama, the process could take longer than a normal Housing Court case in that they need to get a Certificate of Eviction. Housing Court itself can take anywhere from a few weeks to several months.

If you said other tenants are in the same boat, it would be wise for you to create a tenant association and consult with a tenant lawyer on a group basis. In some cases you might have tenancy rights that you might not know about.
