I read on the nyc.gov site that landlords have to repaint every three years - is this true for non-regulated apartments?

Yes. It's in the Housing Maintenance Code, which covers all units. It can also be less than every three years if it needs it. However, it doesn't make a lot of sense to just demand painting only because the three years have expired if it's not needed.
