Recovery of Security Deposit -- Statute of Limitations, NYC

Postby NN » Mon Oct 24, 2011 3:53 pm

Is there a statute of limitations for going after a landlord for not returning your security deposit, simply to recover it?

I can't find info on this anywhere.

I believe CPLR's section of Statute of Limitations would be applicable. Unless specified separately, it should be six years.

Start here: http://codes.lp.findlaw.com/nycode/CVP/2

See section 213.

But also see section 212-a. While deposits are not rent (with a 4 year SOL), a LL might make the claim, especially if there is a dispute over rent. A stupid judge might buy into that.

TN, thank you. This is hopeful -- I am well within the 4 year mark. :-)
