AirConditioning Surcharge ?

I moved into an apartment in BedStuy 2 months ago. While looking at the apartment the broker said the apartment had central air. We tried to turn it on when we moved in and it didn't work. When I asked the super about it, he told me the landlord charges a 2500 dollar fee for "turning it on". We pay the electric bill so I can't see what the charge would be for. Does anyone have some insight into this ?

Since you're not rent regulated you have to look to your lease. Is the AC or the electricity for it included in the rent? What was represented to you when you rented the place?

BTW, have you checked to see if you should be RS? Many LLs tell tenants they are not RS when in fact they should be.

$2500 sounds like a scam some supers do for just tuning on a switch.

The lease doesn't mention Air Conditioning. The broker said the apartment "has central air" so that could mean anything. Who enforces this type of thing ? Who could I report this to ?

You're not regulated. No one enforces. You have to look at the lease and if warranted, take legal action. But before that you should do your homework. Talk to other tenants and get the real story.

Why didn't you check when you looked at the apartment?


Since it isn't in the lease you would be out of luck from the LL. However, you could complain about the broker defrauding you guys fofr a $2500 fee to the super.
