rent hike after end of lease

After having trouble finding a new apartment, I asked my landlord if I could stay an extra month beyond my lease in my current apartment. He hadn't rented the place and said this was fine.

Stupidly, I assumed I would pay him my current rent for the extra month. I just got my rent bill and it is for about 80% more than the previous rent.

Can he do this? I see elsewhere on the site that 30 days notice is required for a rent hike. Does this hold for my current situation?

yes, by continuing your tenancy past the expiration of your lease, you become a de facto moth-to-month tenant. this means the rent could be raised only if he submitted the increase to you at least 30 days in advance of the next due date.

Thanks, Chris, I thought so--hopefully it was some kind of error--I'll talk to him about it, but it's good to know my rights. Anyone else have an idea about this? How often do you see errors of this magnitude?

My LL has occasionally added a zero to my three figure rent -- and claimed they never noticed the error.

Update, to anyone following this thread:

I spoke with the management company and the person there thought that it was an error, but then asked me if I had signed "the extension." When I talked to the landlord, there was no mention of such a document, and I have not received one. I would assume that whatever is going on with this document, my status is still the same; I don't have to pay the additional rent. Correct?

I'd suggest a polite letter saying there was no increase in rent and that the lease continued for a month at the old terms. That's all. File this under Jerky Landlord No. 23313212/A.
Keep in mind that I am a tenant. Not a lawyer!!!!!
