Roommate moved out

Postby trishy » Wed Feb 05, 2003 9:39 pm

my roommate was on the lease and moved out before the lease was up.

What are they liable for as far as paying me rent & utilities? I'm still living here and i can barely afford my bills and they won't pay up!!!!
I think they should have to pay their share of the rent & utilities until the lease is up!!
Which is for another year & a half, plus the time that's already passed. PLEASE HELP!!

Why would you want to force your ex-roommate to pay rent for over a year instead of finding a new roommate?

he left me in a bind & i really don't have time to find a new roommate and wouldn't know where to look and all my friends already have homes

isn't it still his responsibility?

Me Again is partially incorrect as you are not in the position of a landlord - as you might be if this was a sublet. If you both were on the lease, you are both (assuming the lease says this as most standard leases do) "individually and severally liable." That means the landlord can come after either of you for the full amount. That usually means whoever is left. So check your lease to see if that language is there.

We've not heard of any case where a co-tenant was responsible for mitigating damages. You might have a case against the former roommate for his/her share of the rent, but that's a case you would need to bring, not the landlord (assuming that language is in the lease).

I have searched far & wide to try to find the answer to this & have so far found that he's liable for 30 days rent after he moved out & another place i found that he's liable for the full lease term. I have no clue & don't know what all i could sue him for or if it's even worth it.
