Can stabilized lease be switched to different apt same bldg?

Postby bjcc84 » Thu Nov 08, 2018 4:27 pm

Hello and thanks for any info. Wondering if my landlord can allow me to move into a different apartment in my building and honor my existing stabilized rent/lease in that different apartment? Or is the lease not transferable to a different unit in the same building by law?

RS leases are generally not transferable. So the short answer is No. RS status is tied to the apartment, not the tenant.

There are some exceptions, but it gets legal and complicated. I would consult with an experienced tenant attorney who has done this sort of thing before.
