421-A Stabilization Expiring

Good afternoon and thank you for taking my question.

I recently got a very high rent increase and was wondering if I could do anything about it cause I dont think I can afford it and I would rather not move:

- I signed a lease from 05/01/2021 to 04/30/2022 with a rent of 2500$.
- The next year we renewed for a year for 2600$ a month.
- I recently got a renewal offer for 3000$.

As the rent was a lot higher, I made some research and found that the apartment was 421-a stabilized until this year even though I had never signed the rider.

Another strange thing was that in the rent history looked like this:

Reg Apt Filing Legal Prefer. Lease Begin/End
Year Stat Date Regul Rent Rent
2021 RS 07/29/2021 3137.99 3000 04/01/21 - 03/31/2022
2022 PE 07/18/2022 EXEMPT

My last lease is missing, and the dates and rent provided by the landlord are incorrect.

Did my rent last year carry an illegal increase?

Do I have any recourse for this year?

It does look fishy. You could file a complaint, but before that I would do more research. There are plenty of landlords out there who are skirting the rules on 421a.

Ultimately you may need to consult a tenant attorney as 421a can get complicated. But before that Google "DHCR 421a" and read every document that is on that list (well, at least the first eight links). I could list all the links here, but it's just as easy to Google them.

I would also speak with other tenants (do so quietly so the LL doesn't get wind of what you're doing, at least not yet) and see if they have experienced the same thing and/or have similar concerns. If the building as a tenant association (one that's independent of the LL), speak with them. See if anyone has filed complaints against this building or LL. Some LLs are now facing class action lawsuits for allegations of 421a fraud. Google "housing rights initiative 421a class action"

From what I am reading, the landlord cannot destabilize the rent if the rider was not signed originally, is that correct?

Do you have resources on where I could find an affordable lawyer to talk to?

I think that's correct, but I'm not 100% certain.

A number of tenant attorneys advertise on this site. But any attorney in private practice will be somewhat expensive. I'd shop around an see who might offer a free consultation. A good attorney will give you an honest assessment, bit necessarily what you want them to say.
