EVICTING SUBLET

I am the renter of apartment in manhattan and I rented one bedroom to a man around one year ago. We signed NO contract and he pays in cash without any receit. I have asked this gentleman to leave the room a month ago and he now refuses to leave.
He claims he has the right to stay. I was thinking of changing the lock. Does he have some legal bases for his claim?

if you change the locks you can be arrested.

Unfortunately at this point the only legal way to get him out of the apt is to serve him with 30 days notice of eviction and take him to court if he remains after the deadline. Don't accept any payments from him in the meantime. And like Pointer mentioned above, do your homework on eviction procedure and don't do anything that will get you arrested for illegal eviction.
