Landlord Died....Make Rent Check Payble to Whom?

Hi,

My landlord just died. He was a single man.

Who do I make my monthly rent check payable to?
Him? "Estate of <John Smith>?" Or some other payee?

Would appreciate any reliable info. Thanks!!

Make out checks to "John Smith". (Until you are instructed differently). These checks will NOT be cashed immediately as he is dead but sometime in the future his estate will come to you for payment of rent. Have it! Do not spend your rent money - keep it in the bank! And do NOT write out another check for the rent until you have ALL your uncashed checks in hand. Do not anticipate that you will get to live there rent free because your Landlord died. IF a lot of time passes before you are required to account for the rent, and the Estate does not know what they are doing, you MAY be able to negotiate with them (with CASH) but don't count on it!

I'd suggest witholding your rent for a week or two until you're notified where to send the rent money. If you don't receive any notification, deposit it into an escrow account.

If you send it out now, there's no guarantee someone else won't cash it, or that it will deposited in the right account.
