I am pretty sure that it is not illegal to report you are paying late if you pay after the 1st. Why do you wait til after the first anyway? That is like sending in your VISA payment one day late ... which is also reported to credit agencies. The deal is before or by the (insert date). The 5th, 6th, 4th or whatever just represents a date where a penalty is applied.

My housemate tells me that in some states, notice is required (30 day, or on a rental agreement) before an owner can report. He is an attorney, so I imagine he is correct.
