Return of security deposit

Posted by SCJ on April 07, 1999 at 14:33:40:

My landlord refused to return my security deposit saying that I damaged the bedroom in the apt. I was living in. I am taking him to small claims citing that it was normal wear and tear (nail holes in wall from pictures). I was in a lease with 3 people, where people would leave mid lease and he would just ad the new person onto the bottom of the lease and cross the old ones out. At least 5 people have lived in the room and three years have past since the last time he did repairs. Is there any way that he can single me out for the damage and isn't he supposed to provide me with an itemized statement of why he is keeping my security deposit? I live in New York's Westchester County. Any help would be great, thanks.
